What a slip, trip or fall claim covers

If you were hurt because a shop left a spillage, a council didn’t fix a broken pavement, or a landlord ignored a hazard in a stairwell, you could be owed compensation. Property occupiers have a legal duty to keep their premises safe, and when that duty is broken, you shouldn’t be left to carry the cost. We can help you begin.

What you could be owed

A claim could cover:

  • Your injury — the pain and how it has affected your life (known in Scots law as solatium)
  • Lost earnings — past and future, if you’ve had time off or can’t work as before
  • Treatment and care — rehabilitation, and help from family
  • Out-of-pocket costs — from travel to appointments to aids and adaptations

What you could receive depends on your circumstances.

When you can claim

Under the Occupiers’ Liability (Scotland) Act 1960, occupiers of land and premises owe a duty of care to those who enter. This includes shops, supermarkets, councils, employers, landlords, and car park operators. Where the accident happened in a public place, the same facts are often brought as a public liability claim.

A claim generally needs to be raised within three years of the accident under the Prescription and Limitation (Scotland) Act 1973. Our guide to personal injury time limits in Scotland explains when the clock starts.

How it works

  1. Tell us what happened — answer a few quick questions about your accident and injury
  2. We connect you with Scottish specialists — we pass your details to regulated Scottish solicitors
  3. They take it forward — if you have a case, they pursue your claim under Scots law

A claim of this kind is normally funded by a speculative fee agreement, the Scottish version of no win, no fee, so you’re not taking on the financial risk.

Frequently asked questions

Can I claim if I fell on an icy pavement?
Possibly. Local councils have a duty to maintain public pavements. If they failed to grit or clear a known hazard, you may have a claim.
What evidence helps a slip, trip or fall claim?
Photographs of the hazard, the date and time, witness details, any accident report, and records of your medical treatment all help.
Can I claim if I fell in a supermarket?
If a spillage or hazard caused your fall and the store didn't deal with it appropriately, you may have a claim against them.
